Aparentemente se podrá realizar más deducciones que las permitidas hasta ahora, esto se debe gracias a dos fallos judiciales y a un dictamen de la AFIP.
Les cito el texto (más importante) extraído de la nota de IEco: Ganancias: más deducciones por causas laborales
- Por medio del fallo del Tribunal Fiscal Sala D, del 5 de marzo de 2008, se autoriza la deducción en Ganancias de los gastos de indumentaria del contribuyente (una profesional de la comunicación) debido a su exposición pública, por ser "necesarios para mantener la fuente de ingresos".
- En la misma fecha, otro fallo del mismo tribunal autoriza la deducción en el Impuesto a las Ganancias de.
- Además, el dictamen DAT 69/07 de la AFIP autoriza al trabajador en relación de dependencia a imputar como deducción en su liquidación del Impuesto a las Ganancias, los gastos por el uso y el mantenimiento del automóvil por estar afectado íntegramente a su actividad laboral.
- Relacionado con este tema, luego de la sanción de la Resolución 2437, la AFIP manifiesta expresamente que los empleados podrán computar, anualmente, inscribiéndose en el impuesto, todas las erogaciones que se vinculan con su actividad laboral, incluso a pesar de que no estén previstas en el régimen de retención de cuarta categoría.
Esta noticia nos beneficia a todos los que nos descuentan el impuesto a las ganancias, pero hay que ver como declarar esos gastos extras, ya que no sé si se puede realizar esa declaración en el F.572 o no.
